A federal appeals court will revisit an earlier decision ordering a district court judge to allow the Department of Justice (DOJ) to withdraw its criminal charges against former national security adviser Michael Flynn.
The D.C. Circuit Court of Appeals vacated the earlier decision in a brief order issued on Thursday, setting up a new round of arguments over the DOJ’s controversial move to withdraw its case against Flynn.

Vice President Mike Pence told “Axios on HBO” that he welcomes the idea of bringing Michael Flynn back into government, after the Justice Department moved last week to drop its criminal case against President Trump’s former national security adviser. This episode of “Axios on HBO” debuts Monday at 11pm ET/PT.
Why it matters: Trump said April 30 that he would “certainly consider” bringing Flynn back into the administration. Since Flynn had been accused of lying to the vice president, Pence’s blessing clears an obstacle to him returning to Trump’s inner circle.
The big picture: Trump lavished praise on the decision by his Justice Department to go to court to drop charges against Flynn, who had pleaded guilty to lying to the FBI about his conversations with former Russian Ambassador Sergey Kislyak.
The prosecution of Michael Flynn has been dropped, but the use of his case as a political weapon looks sure to intensify.

Across the country, rank-and-file prosecutors cringed at another extraordinary intervention by Attorney General William P. Barr.WASHINGTON — President Trump and his supporters on Friday praised Attorney General William P. Barr’s decision to drop the prosecution of Michael T. Flynn, even as career law enforcement officials warned that the action set a disturbing precedent and Democrats accused the administration of further politicizing the Justice Department.
“Yesterday was a BIG day for Justice in the USA,” Mr. Trump wrote on Twitter. “Congratulations to General Flynn, and many others. I do believe there is MUCH more to come! Dirty Cops and Crooked Politicians do not go well together!”
But some rank-and-file prosecutors said they saw Mr. Barr’s action as politically motivated and damaging to the department’s credibility. Several compared the move to his forcing prosecutors in February to reduce a standard sentencing recommendation for Roger J.
